Legal & support
Terms of service
Welcome to Deadhead.
These Terms & Conditions apply when you use our website or purchase products directly from us online.
By placing an order, you agree to these terms, plus any other policies referred to below.
Nothing in these terms affects your statutory rights as a consumer.
About us
This website is operated by Deadhead.
In these terms, “Deadhead”, “we”, “us” and “our” refer to the business operating this website.
Using our website
You may use this website for personal, lawful purposes.
You must not misuse the website, interfere with its operation, attempt to gain unauthorised access to it, or use its content for unlawful purposes.
You may not reproduce, copy, distribute, commercially exploit or use any part of the Deadhead website, branding or content without our prior written permission.
Our products
We make every reasonable effort to describe and photograph our products accurately. Because screens display colour differently and our products are made in batches, there may occasionally be small variations in colour, finish or appearance between the website and the product you receive.
These variations do not affect your rights where a product is faulty, damaged or materially different from its description.
Fragrance is also subjective. Product descriptions and fragrance notes are intended to help you understand the character of a scent, but individual perception will vary.
Product safety
Please follow all safety and care instructions supplied with your product.
Candles should never be left burning unattended and should be kept away from children, pets, draughts and flammable materials.
Incense and other fragranced products should also be used only as directed and in an appropriately ventilated space.
Deadhead products are home-fragrance products. Any discussion of scent, mood, emotion or behaviour on our website is not medical advice, and our products are not intended to diagnose, treat, prevent or cure any medical condition.
Availability
All products are subject to availability.
From time to time, a product may sell out after you have placed an order, or we may discover that we are otherwise unable to fulfil it.
If this happens, we’ll contact you as soon as reasonably possible and refund any amount you’ve paid for the unavailable item.
Prices
Prices are shown in pounds sterling (£) unless otherwise stated.
The price shown when you place your order is the price you will pay, together with any applicable delivery charges displayed at checkout.
We may change our prices at any time, but this will not affect orders already accepted by us. If there is an obvious pricing error on the website, we may contact you before fulfilling the order.
You will have the option to continue at the correct price or cancel the affected item for a full refund.
Placing an order
Orders are placed through our secure checkout.
When you submit an order, you are offering to purchase the products in your basket subject to these Terms & Conditions.
You’ll receive an order confirmation after placing your order. This confirms that we’ve received it.
Our acceptance of your order takes place when we send confirmation that your order has been dispatched. At that point, a contract between you and Deadhead is formed. We may be unable to accept an order, for example because:
an item is unavailable
payment has not been authorised
we have identified an error in the price or description
we are unable to deliver to the address provided
we reasonably suspect fraudulent or unauthorised activity
If we’ve already taken payment for an order we cannot accept, we’ll refund it.
Payment
Payment must be made using one of the payment methods available at checkout. Payment processing may be provided by third-party payment providers.
We do not receive or store your complete payment card details ourselves where payment is handled by those providers.
Delivery
Delivery methods, estimated delivery times and charges will be shown at checkout. Delivery estimates are estimates rather than guaranteed arrival dates unless we expressly state otherwise.
We’ll take reasonable steps to deliver your order within the timeframe given. If there’s a significant delay, please contact us and we’ll help where we can.
Our responsibility for your order does not simply end when it is handed to a courier. Your statutory rights relating to delivery remain unaffected.
Please make sure the delivery information you provide is complete and accurate. If you realise you’ve made a mistake, contact us as quickly as possible. We cannot guarantee that we’re able to amend an order once it has entered fulfilment.
International orders
Where international delivery is available, your order may be subject to local taxes, duties or customs charges imposed by the destination country.
These are outside our control, and you are responsible for any such charges. Customs procedures can sometimes cause delays outside our direct control.
Cancellations, returns & refunds
If you purchase from us online, you may have a legal right to change your mind and cancel your order.
Full details about cancellations, returns, damaged products and refunds can be found on our Shipping & returns page.
Nothing in our Shipping & returns policy affects your statutory rights.
Promotions & discount codes
From time to time, we may offer discounts, promotional codes or other offers. Unless stated otherwise:
promotional codes cannot be exchanged for cash
only one promotional code may be used per order
promotions apply only during the stated promotional period
codes may be subject to product, minimum-spend or availability restrictions
Any specific terms shown alongside a promotion will also apply.
Intellectual property
All content on the Deadhead website, including our written copy, photography, illustrations, graphics, logos, fragrance names, packaging designs and other original material, belongs to Deadhead or is used by us with permission.
It may not be copied, reproduced, published, commercially exploited or distributed without our prior written permission.
Sharing links to our website or sharing our social content using the normal features of those platforms is, obviously, fine.
Third-party links
Our website may occasionally contain links to websites or services operated by third parties. We don’t control those websites and aren’t responsible for their content, availability, privacy practices or terms.
A link from Deadhead does not necessarily mean that we endorse everything on the website it leads to.
Our responsibility to you
We are responsible for losses that are a foreseeable result of us breaching these terms or failing to use reasonable care and skill. We aren’t responsible for losses that were not reasonably foreseeable when the contract was formed.
We supply our products for private and domestic use. If you use a product for commercial or business purposes, we will not be responsible for business losses such as loss of profit, revenue, business opportunity or anticipated savings.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to the goods you purchase.
Events outside our control
Sometimes events outside our reasonable control may delay or prevent us from fulfilling an order.
If that happens, we’ll take reasonable steps to minimise the effect of the delay and will contact you where appropriate.
Your legal rights, including any rights you may have where goods are not delivered within an agreed or legally required timeframe, are not affected.
Privacy
We handle personal information in accordance with our Privacy policy.
Please read that policy for more information about what data we collect, why we collect it and how it is used.
Changes to these terms
We may update these Terms & Conditions from time to time, for example if our services change or legal requirements change.
The terms that apply to your purchase will be those in force when you place your order.
Governing law
These Terms & Conditions are governed by the laws of England and Wales.
If you’re a consumer living elsewhere in the UK, you may also be entitled to bring proceedings in the courts applicable to where you live.
Nothing in these terms removes any mandatory legal protections that apply to you as a consumer.
